Non-domestic buildings sit squarely inside CAR 2012 Regulation 4. The dutyholder — usually the landlord for the fabric and the tenant for demised space, per the lease — must hold a current HSG264 survey, an active management plan, and evidence of reinspection and contractor control.

Who is the dutyholder?

In a typical FRI lease, the tenant is dutyholder for the demised space; the landlord retains duty for structure, exterior and communal parts. In service-office and short-lease arrangements, the landlord normally holds the whole duty.

Minimum expected standard

HSG264 survey, asbestos register per demise or per building, written management plan, annual reinspection, contractor permit-to-work referring to the register, and evidence of staff briefing.
