Do I legally need a survey?

All non-domestic premises and the common parts of leasehold residential blocks require an asbestos management survey under CAR 2012. Domestic owner-occupiers are not legally required to commission a survey but are strongly advised to before refurbishment.

How often does the survey need updating?

The HSE expects the asbestos register to be reviewed at least annually and a reinspection survey carried out at intervals appropriate to the condition of the materials — typically every 12 months for AIB and damaged cement, every 24 months for intact cement in stable locations.

Who is the dutyholder for this kind of premises?

The dutyholder is whoever has — by contract or tenancy — responsibility for the maintenance and repair of the premises. For freehold owner-occupiers that is the owner; for leased premises it is determined by the repair and maintenance clauses of the lease; for common parts of residential blocks it is the freeholder or managing agent.

What happens if asbestos is found?

Presence alone does not require removal. The material is recorded on the asbestos register, labelled where appropriate, included in the reinspection cycle and brought into the contractor permit-to-work system. Removal is only required where condition, location or planned works make management in situ impractical.
